Terms of Service

These terms are the agreement between you and Ugoku(“Ugoku”, “we”, “us”) for using the Ugoku app and website. They are written to be read, not skimmed — the health disclaimer in particular matters if you train with us.

1. Acceptance of these terms

By creating an account or using Ugoku, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility

You must be at least 16 years old to use Ugoku. By using the service you confirm that you meet this requirement and that the information you provide is accurate.

3. The service

Ugoku is a training and nutrition application: a workout builder and tracker, strength and cardio logging, nutrition and body-weight tracking, adaptive training plans, and injury-aware exercise substitutions. Features may be added, changed, or removed over time as the product evolves.

4. Health and medical disclaimer

Ugoku is not a medical device, is not a medical or healthcare provider, and is not a substitute for professional medical advice, diagnosis, or treatment.

Everything in Ugoku — training plans, calorie and macro targets, exercise substitutions, and the injury and pain-feedback features — is informational only. The injury-aware features suggest alternatives based on what you tell the app; they do not diagnose, treat, or clear you for anything.

Consult a qualified healthcare professional before starting or changing any exercise or nutrition program, especially if you have an injury, a medical condition, or any doubt about what is safe for you. Stop exercising and seek medical attention if you feel pain, dizziness, or discomfort.

You train at your own risk. Physical exercise carries an inherent risk of injury, and you assume full responsibility for your training choices and their outcomes.

5. Accounts

You are responsible for your account: keep your credentials secure, do not share them, and tell us promptly if you suspect unauthorized access. You are responsible for activity that happens under your account.

6. Acceptable use

Do not misuse the service. In particular, you agree not to:

  • attempt to breach, probe, or circumvent the service’s security or access another user’s data;
  • scrape, harvest, or bulk-extract data from the service;
  • reverse-engineer, resell, or use the service to build a competing product;
  • upload malicious code or interfere with the service’s operation;
  • use the service for anything unlawful.

7. Your content and data

The data you log — workouts, meals, body metrics, notes — is yours. You retain ownership of it.

So that the app can work, you grant Ugoku a limited, non-exclusive license to store, process, and display your data for the purpose of operating and improving the service for you. How we handle it is described in the Privacy Policy.

8. Subscriptions and billing

The Basic plan is free. Paid tiers (Triathlete and Pro) are not yet available, and there is no billing in the service today — no payment information is collected. When paid plans launch, their pricing, billing, renewal, and cancellation terms will be provided at that time and these terms will be updated.

9. Disclaimers

The service is provided “as is” and “as available”, without warranties of any kind, express or implied — including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any training or nutrition outcome will be achieved.

The health and medical disclaimer above applies to everything the service provides: Ugoku’s content is informational, not medical advice.

10. Limitation of liability

To the maximum extent permitted by law, Ugoku and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the service — including injuries or health outcomes connected to your training or nutrition choices. Where liability cannot be excluded, it is limited to the amount you paid us for the service in the twelve months before the claim (which, while the service is free, is zero).

11. Indemnification

You agree to indemnify and hold harmless Ugoku and its operator from claims, damages, and expenses (including reasonable legal fees) arising from your violation of these terms or your misuse of the service.

12. Termination

You can stop using Ugoku at any time, and you can ask us to delete your account and data by emailing privacy@ugokuhealth.com. We may suspend or terminate accounts that violate these terms or misuse the service.

On termination, your right to use the service ends. Your data is handled as described in the Privacy Policy — deleted on request, with residual copies in backups purged over a limited period.

13. Governing law

These terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. If you use the service from elsewhere, local consumer-protection rights that cannot be waived still apply to you.

14. Changes to these terms

We may update these terms as the service evolves. When we do, we will update the “Last updated” date on this page, and for material changes we will notify you in the app or by email. Continuing to use Ugoku after a change means you accept the updated terms.
